Appeals
Whatever the plea, if an unrealistic penalty is imposed an appeal can be made to the Crown Court. If a trial is unsuccessful an appeal can be made against conviction and/or sentence, again to the Crown Court. These appeal are re-hearings, but if it is felt that the Magistrates have made an error in the law, then an appeal by way of case stated can be made to the Criminal division of the High Court which sits at the Royal Courts of Justice in London.
